How probate works in Indiana, in plain words
Every estate is different, and your probate attorney is the right person for legal advice. But here is the general path most Indiana families follow.
- Someone is put in charge. The court appoints a personal representative, often the person named in the will. Once appointed, they receive letters from the court that give them authority to act for the estate.
- Creditors get a window. Notice goes out, and creditors have about three months to file claims against the estate.
- The house can usually be sold during probate. In many Indiana estates the personal representative can sell the house without a court hearing. In a supervised estate the court signs off on the sale first. Your attorney will know which applies to you.
- Bills get paid and the rest is divided. The mortgage, taxes, and other debts are paid from the estate, and what remains goes to the heirs.
- Some houses skip probate. If the house had a transfer on death deed, or was owned jointly with survivorship, it may pass straight to the beneficiary. Smaller estates may also qualify for a simpler process.
Probate in Indiana often takes several months to a year. The good news is that you usually do not have to wait for it to close before you start working on a sale.
